Terms of Service

1. Agreement to Terms
By accessing or using Ported ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including freelancers and any clients who access project portals.
2. The Service
Ported is a client project management platform for freelance web designers and developers. It allows you to create projects, share client portals via persistent links, manage milestones, collect approvals, and share files and updates with clients. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Your Account
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@useported.app if you suspect unauthorised access. You must be at least 18 years old to use Ported.
4. Subscription Plans & Billing
Ported offers a free tier and paid subscription plans. Paid plans are billed monthly or annually through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis. You may cancel at any time — cancellations take effect at the end of your current billing period. We do not offer refunds for partial periods. We reserve the right to change pricing with 30 days' notice.
5. Acceptable Use
You agree not to use Ported to: (a) violate any applicable law or regulation; (b) infringe the intellectual property rights of others; (c) transmit malicious code, spam, or unsolicited communications; (d) attempt to gain unauthorised access to the Service or its related systems; (e) resell or sublicence access to the Service without our written consent. We reserve the right to suspend accounts that violate these terms.
6. Your Content
You retain ownership of all content you upload to Ported — including files, project data, and communications. By uploading content, you grant us a limited licence to store and transmit it solely to provide the Service. You are responsible for ensuring you have the right to upload and share any content you add to the platform. We do not claim ownership of your content and will not use it for any purpose beyond operating the Service.
7. Our Intellectual Property
Ported, its logo, product design, and underlying software are owned by us and protected by applicable intellectual property laws. Nothing in these terms grants you any right to use our trademarks, trade names, or branding without our prior written consent.
8. Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you consent to our data practices as described there.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, Ported and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Ported and its team from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.
12. Termination
We may suspend or terminate your account at any time if you breach these terms or if we reasonably believe your use poses a risk to the Service or other users. You may delete your account at any time. Upon termination, your right to use the Service ceases. We may retain data as required by law or our data retention policies.
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
